1. Acceptance of Terms

By accessing or using SentByPro (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, you may not access or use the Service.

2. Description of Service

SentByPro is an email marketing platform that provides tools for creating, sending, and analyzing email campaigns. The Service includes contact management, list segmentation, template design, campaign automation, and analytics.

3. Account Registration

You must provide accurate, complete, and current information when creating an account. You are responsible for safeguarding your password and for all activity that occurs under your account.

4. Acceptable Use

You agree not to use the Service to:

  • Send unsolicited bulk email (spam)
  • Send emails to purchased or rented lists
  • Transmit content that is illegal, harmful, or offensive
  • Impersonate another person or entity
  • Violate any applicable anti-spam laws (CAN-SPAM, GDPR, CASL)
  • Interfere with or disrupt the Service

5. Email Sending Compliance

All emails sent through SentByPro must comply with applicable anti-spam legislation. You must include a valid physical mailing address and a working unsubscribe mechanism in every email. You must honor unsubscribe requests within 10 business days.

6. Subscription Plans and Billing

SentByPro offers both free and paid subscription plans. Paid plans are billed on a monthly or annual basis. You may upgrade, downgrade, or cancel your plan at any time. Refunds are handled in accordance with our refund policy.

7. Data Ownership

You retain all rights to your data, including contacts, email content, and campaign analytics. SentByPro does not sell, share, or use your data for any purpose other than providing the Service.

8. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice.

9. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, your data will be retained for 30 days to allow export, after which it may be permanently deleted.

10. Limitation of Liability

To the maximum extent permitted by law, SentByPro shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.
